Is the default Matomo cookie handling DSGVO conform?

I’m using SiteJet Builder via Plesk. The cookie banner concerning the Matomo stuff contains an opt-out checkbox. I read that this is not conform to German DSGVO and I’d need opt-in checkbox.
Is this correct and if this the case how can I change this or how can I omit the whole Matomo stuff?

Hey Clemens,

We do not have Matomo integrated with Sitejet Builder in Plesk. Are you thinking about adding Matomo as a third party solution?

Hi Andre, that’s good news since I wanted to get rid of it anyway. But then I am surprised that the following is written at the end of the generated privacy policy: “Ihr Besuch dieser Webseite wird aktuell von der Matomo Webanalyse erfasst. Diese Checkbox abwählen für Opt-Out.” This text I wanted to get rid of DSVGO requires me to follow an opt-in approach rather than a opt-out approach. We may continue in German if you like.

Well, the privacy policy is taken over from Sitejet Studio where we got Matomo included as an option.

I highly recommend this thread about some more info: Data privacy / Datenschutzerklärung - #2 by Ulf_Siemen

The topic is quite abstract and complicated. I am currently also working on a FAQ to give you a better understanding.

My personal view: In the end, it all got so complicated that I highly recommend a professional consultation for questions and specific tools for Cookie handling.

In general, of course, you agree with you, but in my particular case it we talk about a simple one-pager without a contact form and without custom elements. If the cookie is used exclusively to enable or disable Matomo web analytics, I see the following as a solution for my case:

  1. Manually remove the chapter on Matomo from the DS Statement and insert that no cookies are used at all.
  2. Remove the Cookie Bar
The second best solution would be to use the Cookie Consent Bar instead of the Cookie Bar.
    What do you think?
